Tailored Support for Unique Circumstances

At Simpson Law Firm, special needs planning is deeply personal to us. Several of our team members have loved ones with disabilities, and we understand—firsthand—the unique joys and challenges that come with preparing for their future. Whether you are a parent, sibling, grandparent, or guardian, we are here to help you navigate the legal tools that can provide protection, security, and peace of mind for your family.

Planning with Purpose

Caring for a loved one with special needs requires careful coordination—emotionally, medically, legally, and financially. Our goal is to help you build a plan that honors your loved one’s dignity and ensures they are supported long after you’re no longer here to do it yourself.

Some of the most common planning needs include:

  • Guardianship and Conservatorship: When a child with special needs turns 18, you may need to pursue legal authority to continue making medical, financial, or housing decisions for them. We walk families through the process of obtaining Guardianship or Conservatorship, when appropriate.

  • Long-Term Planning Through Your Estate: It’s not enough to care for your loved one during your lifetime—you also want to ensure that the right people are named to step in after you’re gone. We help families designate future Guardians and Conservators in their Wills and Trusts so that transitions happen smoothly, with your wishes clearly laid out.

Preserving Benefits Through a Special Needs Trust

Many individuals with disabilities rely on government benefits such as Medicaid or Supplemental Security Income (SSI). Unfortunately, receiving a direct inheritance—even with the best of intentions—can cause these benefits to be reduced or lost altogether.

That’s where a Special Needs Trust (SNT), also called a Supplemental Needs Trust, becomes essential. By creating a trust, you can:

  • Set aside money or other assets to benefit your loved one

  • Appoint a Trustee to manage those assets responsibly

  • Ensure that the trust funds supplement rather than replace public benefits

  • Prevent disruptions in medical care or housing support

  • Provide for quality-of-life expenses, such as therapy, travel, or recreation

After your loved one’s passing, any remaining funds can be distributed according to your wishes—whether to other family members, charitable causes, or held in trust for another individual.
